PinMapper Terms of Service

These Terms of Service ("Terms") govern your use of the PinMapper mobile application ("App") operated by Kirway LLC ("we," "our," or "us").

1. Acceptance of Terms

By downloading, installing, or using PinMapper, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

2.1 Core Service

PinMapper is a mobile application that:

• Extracts location data from your photos' GPS metadata
• Creates interactive map pins from your photo locations
• Organizes locations with customizable categories
• Provides map visualization of your photo memories

2.2 Premium Features

Premium subscription includes:

• Unlimited location pins and photo pins
• Unlimited custom categories
• Data export (CSV, JSON, GPX formats)
• iCloud sync across devices
• Advanced map customization options
• Backup and restore functionality

3. User Accounts and Subscriptions

3.1 No Account Required

• PinMapper does not require user registration
• All data is stored locally on your device
• Premium features are tied to your Apple ID

3.2 Subscription Terms

• Premium subscriptions are processed through Apple's App Store
• Lifetime unlock: $19.99 one-time, never renews
• Monthly subscription: $3.99/month
• Yearly subscription: $19.99/year with 7-day free trial
• Subscriptions auto-renew unless cancelled 24 hours before renewal
• Free trial converts to paid subscription unless cancelled

3.3 Cancellation and Refunds

• Cancel subscriptions through your Apple ID account settings
• Refunds are subject to Apple's App Store refund policy
• Cancellation takes effect at the end of the current billing period

4. Acceptable Use

4.1 Permitted Use

You may use PinMapper for:

• Personal, non-commercial mapping of your photo locations
• Organizing and visualizing your travel memories
• Exporting your data for personal backup purposes

4.2 Prohibited Use

You may not:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer or modify the App
• Share your subscription access with others
• Use the App to violate others' privacy or rights

5. Intellectual Property

5.1 App Ownership

• PinMapper and all related intellectual property are owned by Kirway LLC
• The App is licensed, not sold, to you
• You receive a limited, non-exclusive license to use the App

5.2 Your Content

• You retain all rights to your photos and location data
• You grant us permission to process your data as described in our Privacy Policy
• You can export or delete your data at any time

6. Privacy and Data

6.1 Privacy by Design

• All photo processing occurs locally on your device
• Your photos never leave your device
• Location data is only stored locally or in your personal iCloud account

6.2 Data Accuracy

• Location data accuracy depends on your photos' GPS metadata
• We are not responsible for incorrect location information
• You can manually edit or delete any location data

7. Disclaimers

7.1 Service Availability

• The App is provided "as is" without warranties
• We do not guarantee uninterrupted service
• Features may change or be discontinued with notice

7.2 Location Accuracy

• Location data depends on your photos' GPS accuracy
• We are not responsible for missing or incorrect location data
• Reverse geocoding may provide approximate location names

7.3 Device Compatibility

• PinMapper requires iOS 17.6 or later
• Some features may require specific device capabilities
• Performance may vary based on device specifications

8. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the App
• We are not responsible for data loss due to device failure or user error

9. Premium Subscription Terms

9.1 Free Trial

• Yearly subscriptions include a 7-day free trial
• Trial automatically converts to paid subscription unless cancelled
• Previous subscribers may not be eligible for additional free trials

9.2 Billing

• Subscriptions are billed through your Apple ID account
• Payment is charged to your Apple ID at confirmation of purchase
• Subscriptions auto-renew unless cancelled 24 hours before renewal

9.3 Feature Access

• Premium features are available only during active subscription
• Features remain accessible during billing grace periods
• Data remains on your device even after subscription ends

10. Termination

10.1 By You

• You may stop using the App at any time
• Delete the App to remove all local data
• Cancel subscriptions through your Apple ID settings

10.2 By Us

• We may terminate service for violations of these Terms
• We will provide reasonable notice before termination
• You retain access to your local data after termination

11. Updates and Modifications

11.1 App Updates

• We may update the App to improve functionality
• Updates may be required for continued use
• New features may be added to premium subscriptions

11.2 Terms Changes

• We may modify these Terms with notice
• Continued use constitutes acceptance of new Terms
• Material changes will be highlighted in app notifications

12. Governing Law

These Terms are governed by the laws of New York, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of New York.

13. Apple App Store

13.1 Third-Party Beneficiary

• Apple is a third-party beneficiary of these Terms
• Apple has the right to enforce these Terms against you
• These Terms are between you and Kirway LLC, not Apple

13.2 App Store Rules

• Your use must comply with Apple's App Store Terms of Service
• Apple is not responsible for the App or its content
• Apple has no obligation to provide support for the App

15. Severability
